A mistrial is not an acquittal or a declaration of the defendant's innocence.
In this case, the jury did not declare Chris Facione innocent of charges that he slept with one of his under-aged ball players. The judge was forced to declare a mistrial because the jurors could not reach a unanimous verdict. Which means that some jurors did not think was guilty beyond a reasonable doubt, and some jurors believe he is guilty beyond a reasonable doubt.
