Team Monies: What happens when.......

by NUTJOBFASTPITCHDAD » Mon Aug 23, 2010 5:32 am

What happens to "TEAM" funds when you cut your treasurer's DD?????

This has come up and now this person is refusing to cooperate in turning over team funds. They are attempting to divide up sponsor monies and mail "individual check" back to players, is this common? and/or should legal action be taken on our behalf. Its not he amount, it the thought of being deciteful with the money that the kid have raised.

Any thoughts?

Screwed! Especially if there's no secondary signature required on the checking account. If you do have another person on the account...close it and start over.

If the treasurer is making an attempt to return funds collected as it sounds then there is probably no way your going ot be able argue amounts.

If that is not the case a trip the county DA's office is probably in order.
As long as it is not Dallas or Tarrant county which you will never get any help from them!

In that case a string worded letter from an attorney may help.

In Collin, Denton, Wise etc You would seek a "fraud" charge against the person and every player on the team is going to need to sign as the complainant.

Dont let them feed you that hogwash it is a cvil matter either, it is a theft!

The treasurer really needs to get thier head on straight as having a criminal charge leveled against them may exclude them from future involvement in youth sports!

Good luck with that one. You'll be one of several thousand claims...and I'll bet the DA's office will drop everything and get right on it.

No that is not common. What should happen is that the former treasurer and the new treasurer meet at the bank and do the paperwork to turn the account over. Should take about 15 minutes to accomplish. I've done this before when I was treasurer of a local professional club. This is just MHO but I don't think your former treasurer has done anything criminal. You cut his/her DD and this sounds like sour grapes and not wanting to do you any favors. Take the checks, ask the families to turn them over to the team, and open a new account with two sigs required on every check. Lesson learned.

Unless there was an agreement before hand, all team monies belong to the team. I have seen in rare situations where funds were returned to a company that was sponsoring a child so she could play. I think in that situation, the tournaments were paid for in advance and funds should go back.

With our organization, money from fundraisers is divided among the kids that participate and those funds can be applied to a variety of different things. If a player departs, the funds are forfeited back to the overall team account. It adds more time to the bookkeeping aspect, but makes it easier if there is an audit.

Because of the large check I received yesterday at practice, I might make a large donation to the Donkey's with the remaining funds to see if the Rev will really match.

Ideally, the treasurer should not be a parent of someone involved with the team. However, we don't always have that luxury when looking for help.

The concern that I have here is the individual checks being sent out. There is really no reaso for that to be done. If I was the coach, I would definately call the previous treasure and demand, yes demand, a lump sum check made out to the team that would then be reallocated on an equal basis to each players account. If he refuses to do that, I would at the minimum ask to see an updated account balance so you at least know the funds are there. I would think that it's common knowledge that any funds in each childs account does not belong to the family per se. If my balance is $100 due to fundraising activities, I know that if my daughter leaves her team I'm not getting a check for $100. Good luck.

All these responses are good food for thought.

Our former treasurer was also a coach etc so he is having issues with being cut from the team as well. In the opinion of our parents this is just being petty to penalize out girls because his child didn't make the team. My son has left one team for another and we never looked back for ANY type of fundraising money. If your child changes schools you don't go back to the school and ask for the fundraising back to take to the next school......We realize that he is just being an A$$H0!E about the situation but is their anything I could do about this? He was/is the SOLE signer on the account.

What kind of coach doesn't have the forsight to have a handle on this before he cuts the player and treasurer/coach? I realize the guy is being a db but the coach should have started getting someone else invovled in the process so there was a seemless transition.

If he's the sole signer, and he hasn't run off with your money, there's not much you can do but ask the families to sign their checks back over to the team. Yeah he's being childish and immature and throwing a big temper tantrum here. Just be happy he's giving the money back in some fashion. Now you have the luxury of setting up a new account that requires dual signatures so no one can ever do this again.
