Why don't you go ahead and educate all of us how a "criminal California Law Enforcement Telecommunications System order" works under the facts and circumstances of this statutory rape case and why this judge couldn't impose as a condition of bail an order that this coach not attend softball games, practices, etc if the judge thought him to be a danger (clearly the judge and TNL knows something you don't know). . . I'm so waiting for this explanation.

I see google is working for ya. Good for you! Not that I believe that you can grasp what I am going to tell you, since you were not able to comprehend my previous post, which is EXACTLY how this stuff goes down.. I'll try anyway.

First, you need to google up PC 136.2. This is the section of law that I was applying for this case. You will see CPO's are issued restraining from specific persons and places for specific cause. While you are googling, google up CA Judicial Council form mc-220a. With that googling, you can actually see the form and see it is very specific as to person and place. I would doubt they have enough to persuade a court to go outside the norm and issue some blanket vanilla order, especially when it is probably not even part of the case, especially at a pre prelim phase. At this point VERY LITTLE has gone on in the case.

Secondarily, he is not O/R'd. He is out on Bail. There is a big difference. Often with O/R you have certain conditions (such as a search waiver).

Doubtless there is (or soon will be) a CPO for the victim in this case since that is routine in criminal cases. I've never seen a blanket CPO issued covering issues unknown such as where a tournament may be and entire regions and unnamed groups of people as a condition of BAIL or as part of a CPO. I suppose it could happen; I've NEVER seen it and I've dealt with thousands of criminal and civil restraining orders. That type of stuff usually comes post sentencing (if by some miracle they get that far) as conditions of probation (which is probably the most he is going to get if it goes all the way.).

That is why my post was aimed at TD's doing something. I think you missed that.. A TD taking action on their own. My thinking would be for the interests of the safety of all involved participants, including even the Defendant or innocent bystanders standing next to the defendant, since not everyone takes these types of things well.

Now stop being a jerk for two seconds and read my posts and you might actually be able to learn something as to how this stuff really does work. Umpiring is hobby. Defendants are a living.

As a family, we could spill some dirty laundry about the player but WE won't because it is FAMILY business and we are dealing with it as a family. IF you aren't apart of the TNL family, really you are clueless and should just go mind your own business and make sure your back yard is clean before you start JUDGING others. MAY GOD KEEP OUR TNL FAMILY AND BRING PEACE. STRENGTH AND RESOLUTION TO ALL THOSE INVOVLED IN THIS ISSUE. WE ARE STILL TNL.

Yeah, save thrashing the girl if it actually gets to trial (but we know it wont dont we? The shot across the victim's bow has been fired...). This public forum would not be in the defendants best interest at this stage. That is very good strategy on TNL's part. Keep that stuff close to the vest (but let it known you might have something), up your sleeve even.

The real killer confessed to his atty but the atty could say nothing due to atty/client privelage. The guy died last year and the atty released the signed affidavit.

Until YOU have been involved in a court case, you will never have a clue. I have been involved in family, civil and criminal cases and 99% of people do not have a clue as to what actually happens. I am not going to go into detail but I have seen 3 police officers give completely different and CONFLICTING versions, yet the judge ignored it all.

Dont have so much faith in the legal system.

You and AF seem to be missing the point entirely. Whether the justice system churns out perfectly accurate determinations of guilt or liability is completely irrelevant to what we are talking about here, which is whether the filing of charges (plus the release of limited but fairly condemning evidence) is enough to justify keeping this guy away from the kids until there is a final legal determination. Anecdotal stories about wrongful convictions--or even wrongful accusations--are pointless. So are statistics about either, unless they show that people charged crimes are no more likely to have committed them than your average Joe. Otherwise the fact that charges were filed means something.

Look, I trust the government and its employees about as far as I can throw bucketdad96 ( ). But I do trust people to look out for their own best interests, and it's simply not the case that prosecutors can get away with filing charges left and right without credible supporting evidence. And other than in high profile matters like the Duke case (where I remind you that the prosecutor was ultimately disbarred and is facing worse) what would be the incentive? It's not like they're sitting on their thumbs all day hoping a crime will be committed--they're slammed as it is. Doesn't add up.

Skarp, it doesnt start with the DA, it starts with the police. They arrest you, bend the truth sometimes, write their reports to reflect their version and BAM. You are no longer innocent but guilty. Now you have to spend the money to prove your innocence.

My point is that the legal system is not as just and fair as people make it out to be. I have had some bad experiences and it just gripes me when I hear people talk how fair the police are and oh let the court do its job. I am not trying to debate the merits of this specific case.

And I agree, this guy should not be anywhere near a ball field until the charges are dropped or he goes to trial and is found innocent. Any other outcome and he should NEVER come back.

Am I worried hes going to do something? Not really. As mentioned you already have to assume theres a Chester everywhere you go. Just with all the publicity, and this being his bread and butter, hes an idiot for showing up to any event

I think all anyone knows is what has been in the paper and it said that there are TMs between the coach and the player. It is not difficult for the wireless companies to recreate those communications. I am betting if there are TMs there could be Internet communications also. Used to be we looked for a paper trail. Anymore perps are hanging themselves with an electronic trail.

Fortunately, everyone gets their day in court.

But truthfully, if I had been accused of this twice in a few years, I wouldn't step out of the house for fear of being accused again. And, I would keep ahold of my spouse's hand.

If any of you knew him at any other level then just by the lies that you read you to would feel the same way too. I guarentee you if your daughter was fortunate enough to be apart of this organization, and you got an opportunity to know this coach and the accusing party you would be in full support of Chris - based on the facts. I am extremely saddened that we as a people can be this horrible, this vendictive and this irrational without knowing anything. It is because of you that our entire world is in the state of unrest. Everyone is filled with negativity and hate with out justification. For 15 years anybody who has been fortunate enough to be coached by Chris not only knows he is the best coach out there but is one of the greatest human beings you will ever meet. STOP the NEGATIVITY and STOP the HATE!!

I remember a friend coming to me and telling that her friends hubbie had been arrested because the daughter finally told that he had been sexually abusing her for years. They assumed because she was quite promiscuis that she was lying. I looked at her and told her the girl was telling the truth, the women wouldnt believe me, and the mother was berating her child for telling lies but finally the girl had told someone and now she was in trouble (makes you wonder why they dont tell). She went on to tell me how wonderful he was and how he helped fund projects for kids with cancer, and how he always volunteered here aned there and what a wonderful guy he was. Well during the trial the guy finally broke down and admitted it all. Imagine the damage control they had to do with that girl...... I do not have faith that justice will be done here. I have seen way to many sexual abuse predators go free. And the fact there may have been more then one time this has happened is enough for me personally.

You guys at TNL want to get mad at parents for protecting their children. Do I feel bad for the TNL people, girls, of course. Gosh I cant imagine the nightmare you guys have to be going thru. But you to have the right to stay or go just like parents here have the right to not participate in a tourney where that Mr Fancione might show up...their rights as parents, and dont even bring in the other girls, I am sure everyone cares about the other girls but their number one priority should be to protect their child, and if they are mistaken all they can do is say sorry because as a parent I would rather make a mistake parenting then put my child in that kind of danger. You can choose what you want to do if you are comfortable so can they. I am not here to judge you but rather to protect my child personally...and no one will ever take that away from me, for any reason, and if I have to be accused of protecting just mine kid...then I stand accused and will deal with the guilt. I hope the best to the TNL people, and hope your organization weathers this...as for Mr. Fancoine well you dont want to know what i think of him

Not always, but frequently. In cases where the evidence is "objective" (DNA, video tape, etc.) rather than "subjective" (who do you believe cases) they rarely go to trial because the perpetrator is convicted on the science. Case that go to trail are frequently of the "subjective" kind and frequently involve many, many, many, many district attorneys are only concerned with whether they can convict, and not whether their witnesses are lying, of questionable repute, etc. Other times, the District Attorney chooses not to prosecute because of who the alleged perpetrator is (ie., the Kennedy case, etc.) On cases that actually proceed to trial, the concept of innocent until proven guilty was long ago replaced in the actual courtroom with guilty until proven innocent. If you don't believe this, I'm sorry to challenge your ideas about the criminal justice system in America, but too often, the guilty go free and the innocent go to prison. And yes, that is terrible.

So you are a defense attorney. I am not naive...I am quite intelligent and don't particularly buy your argument that innocent people go to prison...an innocent person may be charged...but they don't go to prison. We've also seen enough jury decisions to know that you are dead wrong on your assertion that defendants are treated as guilty in the courtroom. The facts don't bear out your argument.

TNL Parents,

I know you love CF and he's been to your home...and he's done great things for you DD...and he's a great guy and you couldn't imagine him doing anything like this...and he's innocent until proven guilty....it's all a load of crap and nobody cares. Personally I know, and was friends with, 2 sexual offenders. I never would have thought that either of these guys would have done what they did...but hey sure as hell did what they were convicted of. The problem with you TNL parents is that YOU DON'T KNOW WHAT HE DID ANY MORE THAN WE DO. Outsiders do know ONE thing...he was arrested and charged...they have evidence.

People who choose to boycot playing your organization have every right to do so...but you have no right to be indignant about it or to judge those of us who would choose not to place our daughters on the field to be ogled by your dinner guest. We don't care that you like him...I care that he might ask my 16 year old to the prom, get her drunk and take her to a motel.

You people shouldn't be defending him here on this board...you should be contrite and be pulling CF aside and telling him to vanish from the fields until he proves himself innocent. You people should be mad at the damage he has already caused the TNL organization, once a fast riser....now doomed to extinction. Just do the right thing....for once...

Interesting you would bring that up.

In fact, I think you are all aliens, and once all the other TNLs join Heybucket you will proselytize using your collective consciousness and warp my sense reality to the point that I too welcome predators at the ball field. Before that happens I think I'd best take my leave of this thread and free you all up to report back to your commander.

Did anyone mention Kool-Aid?

Most of you don't know any of the TNL parents, players or coaches and we can all sit here and say what you would do in this circumstance. We choose to look at Chris as innocent until proven guilty, that is our choice. Too many people are quick to judge, put the shoe on the other foot, wonder if it were you being accused or your DD's coach? We can all say what we would do but until you are dealing with it, you DON'T know. You can say, I would pull my DD off of the team ASAP, I would ban this or that, you DON'T know until you have been apart of the issue. We are dealing with it the best way we can for our DDs and our organization. We are all parents lke you who get up the same time you do, spend our entire weekends, spend out money so our DDs can go and play softball. Our DDs love softball as much as your daughters do. Our DDs love their coaches as much as your DDs do. Let it rest until the court decides. I wonder how different you would feel if it wasn't CF and it was YOU being accused. I just wonder. OH but that is right, it would never happen to one of you ?? We are not to JUDGE.
